General Conditions of Sale for purchases made online at www.stopandgoparma.it
STOP AND GO S.A.S. di Maura Ricco' e C., Via Cascinapiano 3, 43013 Langhirano, invites users to read these General Conditions of Sale that govern the purchase of products and the management of orders made on the website www.stopandgoparma.it.
1. Conclusion of contract and delivery of products
1.1 When the customer places a purchase order through the www.stopandgoparma.it website, the relative sales contract between the customer and STOP AND GO S.A.S. will be administered according to these Terms and Conditions, and specifically according to the Terms of Purchase mentioned below.
1.2 By clicking on Confirm, the customer places a binding order for the items contained in the virtual shopping cart. Once the order has been placed, STOP AND GO will send an email confirming the order to the email address provided during the registration process. The sales contract is concluded between STOP AND GO and the customer when the customer receives the order confirmation.
Orders for which the customer has opted for payment in advance will be dispatched as soon as STOP AND GO S.A.S. receives full payment of the purchase price and any shipping costs. STOP AND GO therefore invites the customer to pay the price as soon as they receive confirmation of the order and in any case within the next 7 days.
1.3 If the products ordered are not available for reasons beyond STOP AND GO's control, STOP AND GO must notify the customer immediately. In such a case, STOP AND GO is not obligated to deliver the ordered goods, unless STOP AND GO has assumed the procurement risk for the products of the order in question.
In any case, if the ordered goods are not available, STOP AND GO will refund any sums already paid to the customer without delay.
1.4 STOP AND GO is not responsible for searching for and obtaining unavailable products from other sources. This also applies to orders for fungible goods (for which only the type and characteristics of the products are described). STOP AND GO is only obligated to deliver what is in stock and what has been ordered from its suppliers.
2. Prices, shipping costs and express delivery
2.1 The customer is obligated to pay the price published on the product page when placing the order. The price indicated is final and inclusive of VAT (where applicable).
2.2 Shipping costs are charged to the customer, unless the total amount of the order does not reach 100 Euro.
3.1 STOP AND GO accepts various methods of payment including, but not limited to: credit card, bank transfer, Paypal and cash on delivery. STOP AND GO reserves the right to refuse certain payment methods and to request different payment methods for certain orders. In the case of payment by bank transfer please note that the customer is responsible for any costs associated with the transaction.
3.2 In the case of a purchase made by credit card, the charge is made when the order is registered.
3.3 The purchaser agrees to receive invoices and credits exclusively in electronic format.
4. Right of withdrawal for STOP AND GO products
The customer has the right to withdraw from any order placed on www.stopandgoparma.it, without giving any reasons and with any statement, as long as it is explicit, delivered to STOP AND GO.
If the customer wishes to return the purchased products, he/she can use the return procedure on www.stopandgoparma.it. If the customer has problems completing the return procedure or needs assistance, he/she can contact Customer Service (contacts at the bottom of the page). Please always follow the return procedure on www.stopandgoparma.it in order to avoid delays and unnecessary additional costs.
4.1 Information about the right of withdrawal (ex art. 49, paragraph 1, letter (h) of Legislative Decree no. 206/2005 "Consumer Code") The customer has the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires after 14 days from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the case of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the 14-day period begins on the day on which the customer or a third party other than the carrier designated by the customer acquires physical possession of the last good. In order to exercise the right of withdrawal, you must inform STOP AND GO S.A.S. (firstname.lastname@example.org) of your decision to withdraw from this contract by means of any explicit statement to that effect (e.g. by a letter sent by post, fax or e-mail). For this purpose, it is sufficient to submit any express declaration of your decision to withdraw from the contract.
You can also complete and send the standard withdrawal form or any other explicit declaration of withdrawal electronically via the STOP AND GO website. In this case, STOP AND GO will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by e-mail) without delay. The deadline for withdrawal is deemed to have been met if the customer sends his or her declaration before the expiry of the 14-day period from the day on which the customer or a third party other than the carrier and designated by the customer acquires physical possession of the last item ordered. In the case of a contract for several goods ordered by the customer in one order and delivered separately, the 14-day period begins on the day on which the customer or a third party other than the carrier designated by the customer acquires physical possession of the last good.
4.2 Effects of withdrawal Following withdrawal from this contract, STOP AND GO will refund all payments made by the purchaser, including delivery costs (with the exception of any additional costs resulting from choosing a type of delivery other than the standard type offered by STOP AND GO), without undue delay and in any case no later than 14 days from the day STOP AND GO is informed by the customer of the decision to exercise the right of withdrawal. Such refunds will be made using the same payment instrument used by the customer at the time of purchase, unless otherwise agreed. In any case, the customer does not incur any costs as a result of this refund. Refunds may be suspended until STOP AND GO receives the returned products or until the customer can prove that the products have been shipped, whichever comes first.
The customer must return or deliver the products without undue delay and in any case within 14 days from the day on which he/she communicated his/her wish to withdraw from the sales contract.
The Products must be returned
- correctly packed in their original packaging, not damaged or soiled and equipped with all accessories, instructions for use and documentation;
- with the document that can be obtained at the end of the return procedure, so that STOP AND GO can identify the customer (Order number, name, surname and address);
- without any obvious signs of use, except for those that are compatible with a normal test of the item (the item must not bear any traces of prolonged use or in any case of use exceeding the time necessary for a test and must not be in such a state as to prevent resale).
If the returned product does not comply with the requirements of the preceding paragraph, the withdrawal will not be effective. STOP AND GO bears the costs of returning the goods for orders delivered to Italy if the customer uses the return documents provided by STOP AND GO and sends the goods from the country in which they were delivered. Otherwise the costs of the return are borne by the customer. The customer is responsible for any decrease in the value of the goods resulting from handling the goods in a way that is not necessary to establish the nature, characteristics and function of the goods.
Invoices will be issued in electronic and paper format.
5.1 Refunds are credited directly to the account or payment instrument used at the time of purchase. For payments made by bank transfer, the refund will be made to the account used for the payment upon communication of the IBAN on which to make the refund by the customer. For payments made by Paypal or credit card, the refund will be made to the Paypal account or credit card. For payments made by cash on delivery, the refund will be made, alternatively, to the bank account indicated by the customer to STOP AND GO or by crediting the customer's account.

7. Warranty for defects and additional information
7.1 Purchases made on STOP AND GO are subject to the provisions of the Consumer Code concerning the warranty for defects and deviations of products. The customer is therefore entitled to the rights set out in Art. 130 of the Consumer Code and these rights must be exercised within the terms set out in Art. 132 of the Consumer Code.
